These Terms of Service (“Terms”) govern your access to and use of the website, toolkit, assessments, forms, and messaging programs (together, the “Services”) offered by Arizona Goldens LLC, doing business as The Service Dog School (“Arizona Goldens,” “the School,” “we,” “us,” or “our”). Please read them carefully.
1. Acceptance of these Terms
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
2. Who we are
Arizona Goldens LLC (d/b/a The Service Dog School) is a limited liability company organized under the laws of the State of Arizona, United States, that has trained service dogs since 2006. You can reach us at P.O. Box 40776, Mesa, AZ 85274, USA; (480) 205-6810; AzGoldensLLC@gmail.com.
3. Description of the Services
The Services include an informational, educational toolkit and one or more assessments that help you decide whether a service dog fits your life, choose a provider, and understand what to ask. Some assessments are free; others may be paid.
Our service-dog training and placement programs are separate paid engagements. They are not purchased or delivered through this website and are governed by their own written agreements between you and Arizona Goldens LLC. If anything in a signed program agreement conflicts with these Terms, the program agreement controls for that engagement.
4. Eligibility and age
You must be at least 18 years old and able to form a binding contract to use the Services. The Services are directed to adults; a parent or legal guardian may use them on behalf of a family member, including a child. Do not use the Services if you are under 18.
5. Your information and consents
You agree to provide accurate, current information and to keep it up to date. When you submit a form, you may separately consent to email marketing and to SMS/text messages. How we handle your information is described in our Privacy Policy.
6. SMS and email program terms
If you opt in to text messages, message and data rates may apply, message frequency varies, you can reply HELP for help and STOP to opt out, and consent to texts is not a condition of purchase. Full details are in our SMS Terms. Marketing emails include an unsubscribe link, consistent with the CAN-SPAM Act.
7. Intended use — no medical advice or guarantee
The toolkit and assessments are educational and informational only. They are not professional, legal, medical, psychological, or veterinary advice, and they are not a diagnosis or treatment. Always seek the advice of a qualified professional for questions about a medical condition, disability, or your animal’s health, and never disregard or delay seeking professional advice because of something you read here.
Nothing in the Services is a promise, warranty, or guarantee of any medical or health outcome, symptom relief, or that a dog will detect, alert to, respond to, or perform any specific task. Service-dog outcomes depend on many factors, including the individual dog, the handler, the disability, ongoing training, and circumstances outside our control. Any specific commitments about a dog or program are set out only in a signed program agreement.
8. Intellectual property
The Services and their content — including text, assessments, toolkits, graphics, logos, photographs, audio, and software — are owned by Arizona Goldens LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services and to view or download materials for your own non-commercial use. You may not copy, reproduce, republish, distribute, sell, or create derivative works from our content without our prior written permission. “Arizona Goldens” and “The Service Dog School” and related marks are ours; you may not use them without permission.
9. Acceptable use
You agree not to:
- use the Services unlawfully or for any fraudulent or harmful purpose;
- submit false, misleading, or another person’s information without authorization;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or their systems;
- upload malware or attempt to overload, scrape, or reverse-engineer the Services; or
- infringe the rights of, harass, or harm others.
10. User submissions
If you submit information, responses, questions, or other content through the Services, you confirm you have the right to share it and you grant us a non-exclusive, worldwide, royalty-free license to use it as needed to operate and provide the Services and to respond to you. Do not submit content you are not authorized to share. We are not obligated to store or return submissions and may remove content that violates these Terms.
11. Payments
Paid assessments and any online purchases are processed by our payment processor, Stripe; by purchasing, you also agree to Stripe’s applicable terms. Fees, refunds, and deliverables for training and placement programs are governed by the separate written agreement for that program.
12. Third-party links and services
The Services may link to or rely on third-party websites and services we do not control. We are not responsible for their content, products, or practices, and your use of them is at your own risk and subject to their terms.
13. Disclaimer of warranties
The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content is accurate or complete. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, Arizona Goldens LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of (or inability to use) the Services, even if we were advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim, or US $100. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Arizona Goldens LLC and its members, managers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
16. Dispute resolution and arbitration
Informal resolution first. If you have a concern, please contact us at AzGoldensLLC@gmail.com so we can try to resolve it. Most concerns can be resolved this way. You and Arizona Goldens agree to attempt in good faith to resolve any dispute informally for at least 30 days before starting a formal proceeding.
Binding arbitration. If we cannot resolve a dispute informally, you and Arizona Goldens agree that any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered by a recognized arbitration provider under its consumer rules, on an individual basis, seated in Maricopa County, Arizona (or by video/telephone where the rules allow), except that either party may bring an individual claim in small-claims court. The arbitrator decides the dispute; judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and Arizona Goldens agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Your right to opt out. You may opt out of this arbitration and class-action-waiver section by emailing AzGoldensLLC@gmail.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms. This section does not apply where it is prohibited by law.
17. Governing law and venue
These Terms and any dispute arising out of them or the Services are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Subject to the arbitration section above, you agree that the exclusive venue for any permitted court proceeding is the state and federal courts located in Maricopa County, Arizona, and you consent to their personal jurisdiction. Nothing here deprives you of the protection of mandatory consumer laws of your country of residence.
18. Changes to these Terms
We may update these Terms from time to time. The “last updated” date above reflects the latest version, and material changes will be posted here. Your continued use of the Services after an update means you accept the revised Terms.
19. General
If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, SMS Terms, and any signed program agreement, are the entire agreement between you and Arizona Goldens regarding the Services.
